Creator Agreement

CREATOR AGREEMENT

This Creator Agreement ("Agreement") is entered into between SwipeFans ("Platform") and the individual or entity accepting this Agreement ("Creator").

By registering as a Creator, uploading content, receiving payments, or using Creator monetization features, Creator agrees to be bound by this Agreement, the Platform Terms of Service, Privacy Policy, Community Guidelines, and all applicable laws and regulations.

CREATOR ELIGIBILITY

To become a Creator, you represent and warrant that:

You are at least eighteen (18) years of age or the age of majority in your jurisdiction, whichever is higher.

You possess full legal capacity to enter into binding agreements.

You have successfully completed the Platform's identity and age verification procedures.

All information provided during registration and verification is accurate and complete.

You are not prohibited by law from creating, distributing, or monetizing adult content.

The Platform reserves the right to deny, suspend, or terminate Creator accounts at its sole discretion for compliance, safety, legal, or business reasons.

IDENTITY VERIFICATION

Before publishing or monetizing content, Creators must complete identity verification.

Required verification may include:

• Government-issued photo identification

• Selfie verification

• Proof of age documentation

• Tax documentation where applicable

• Additional compliance documentation if requested by the Platform

• The Platform may retain verification records as required by applicable laws, anti-exploitation regulations, payment processor requirements, and compliance obligations.

Failure to complete or maintain verification may result in account suspension or termination.

CONTENT OWNERSHIP

Creator retains ownership of all original content uploaded to the Platform.

By uploading content, Creator grants the Platform a worldwide, non-exclusive, royalty-free license to:

• Host content

• Store content

• Stream content

• Display content

• Promote content within the Platform

• Process and distribute content to authorized users

This license exists solely for operation, maintenance, security, promotion, and delivery of Platform services.

CREATOR WARRANTIES

Creator represents and warrants that:

• Ownership Rights

  Creator owns or legally controls all rights necessary to upload, distribute, and monetize submitted content.

• Consent

  Any individual appearing in Creator Content:

  • Is at least 18 years old;

  • Has provided informed and documented consent;

  • Has completed any verification procedures required by the Platform.

• Compliance

  Creator Content does not contain:

  • Underage persons

  • Non-consensual content

  • Sexual assault material

  • Bestiality

  • Incest where prohibited by law

  • Human trafficking content

  • Exploitation content

  • Violence involving sexual acts

  • Illegal activity

  • Copyright infringement

  • Fraudulent or deceptive material

Creator is solely responsible for compliance with all applicable laws.

• Co-Performer Verification

  Creator represents and warrants that every identifiable individual appearing in Creator Content:

  • is at least eighteen (18) years of age or the age of legal majority where required;

  • has knowingly and voluntarily consented to participation;

  • has executed any required release, consent, or verification documentation;

  • has completed any Platform verification requirements applicable to co-performers.

Creator must maintain accurate records demonstrating compliance and provide such records upon reasonable request by the Platform.

• Documentation Requirements

  The Platform may request documentation relating to age verification, identity verification, ownership rights, licensing rights, performer consent, or compliance matters at any time.

  Failure to provide requested documentation may result in content removal, demonetization, suspension, termination, or withholding of payouts pending review.

PROHIBITED CONTENT

The following content is strictly prohibited:

• Content involving minors

• Simulated or actual child exploitation

• Non-consensual acts

• Revenge pornography

• Deepfake pornography involving real persons without consent

• Coercive sexual conduct

• Human trafficking

• Bestiality

• Graphic violence

• Illegal drug distribution

• Terrorism-related material

• Copyright infringement

• Stolen content

• Content violating payment processor policies

Violation may result in:

• Immediate content removal

• Suspension

• Permanent account termination

• Withholding of payouts

• Reporting to law enforcement authorities

CREATOR MONETIZATION

Creators may earn revenue through:

• Subscriptions

• Tips

• Pay-per-view content

• Paid messages

• Livestreams

• Bundles

• Promotional programs

• Referral programs

• Other monetization tools introduced by the Platform

The Platform does not guarantee:

• Revenue

• Subscriber counts

• Traffic

• Earnings

• Exposure

• Marketing results

REVENUE SHARE

The Platform shall pay Creators according to the current payout structure published by the Platform.

The Platform reserves the right to modify:

• Revenue percentages

• Fees

• Processing fees

• Withdrawal thresholds

• Currency conversion methods

• Payment schedules

Reasonable notice will be provided when legally required.

PAYOUTS

Creators may request withdrawals subject to:

• Verification completion

• Fraud review

• Compliance review

• Payment processor approval

• Minimum payout thresholds

The Platform may delay, reverse, reject, or withhold payouts where:

• Fraud is suspected

• Chargebacks occur

• Payment disputes arise

• Verification is incomplete

• Legal obligations require retention

TAX RESPONSIBILITIES

Creators are independent contractors.

Creators are solely responsible for:

• Income tax reporting

• VAT obligations

• GST obligations

• Self-employment taxes

• Withholding obligations

• Regulatory filings

The Platform does not provide tax advice.

CONTENT MODERATION

The Platform may review, restrict, demonetize, remove, or disable access to content that:

• Violates Platform policies

• Creates legal risk

• Violates payment processor requirements

• Threatens user safety

• Damages Platform reputation

The Platform has no obligation to publish or continue displaying any content.

INTELLECTUAL PROPERTY PROTECTION

All Creator Content remains protected by copyright and intellectual property laws.

Users may not:

• Download content

• Record content

• Screenshot content

• Redistribute content

• Resell content

• Leak content

The Platform may pursue enforcement actions including:

• DMCA takedowns

• Account bans

• Legal proceedings

DMCA AND COPYRIGHT CLAIMS

If Creator believes copyrighted material has been infringed, Creator may submit a copyright complaint including:

• Identification of copyrighted work

• Identification of allegedly infringing material

• Contact information

• Statement under penalty of perjury

The Platform may remove allegedly infringing material pending review.

PRIVACY AND DATA PROCESSING

Creator acknowledges that the Platform processes personal information in accordance with the Privacy Policy.

Creator consents to:

• Verification processing

• Compliance monitoring

• Fraud prevention measures

• Payment processing

• Regulatory reporting where legally required

ACCOUNT SUSPENSION AND TERMINATION

The Platform may suspend or terminate a Creator account immediately for:

• Terms violations

• Fraud

• Chargeback abuse

• Identity verification failures

• Illegal conduct

• Safety concerns

Upon termination:

• Access may be revoked immediately.

• Content may be removed.

• Outstanding balances may be reviewed before release.

INDEMNIFICATION

Creator agrees to indemnify and hold harmless the Platform, its owners, affiliates, employees, contractors, and service providers from any claims, liabilities, damages, losses, costs, or expenses arising from:

• Creator Content

• Copyright violations

• Privacy violations

• Regulatory violations

• Breach of this Agreement

DISCLAIMER OF WARRANTIES

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis.

The Platform makes no warranties regarding:

• Availability

• Earnings

• Security

• Performance

• Compatibility

• Subscriber activity

LIMITATION OF LIABILITY

To the maximum extent permitted by law, the Platform shall not be liable for:

• Indirect damages

• Consequential damages

• Lost profits

• Lost business opportunities

• Data loss

• Reputational harm

Total liability shall not exceed the amount paid to the Creator by the Platform during the six (6) months preceding the claim.

GOVERNING LAW

This Agreement shall be governed by the laws of:

Any disputes shall be resolved exclusively in the courts of that jurisdiction unless otherwise required by law.

MODIFICATIONS

The Platform may modify this Agreement periodically.

Continued use of Creator services following publication of updated terms constitutes acceptance of the revised Agreement.

Termination

Either party may terminate this agreement at any time with appropriate notice or by account closure.

Upon termination, licenses end except for continued access by users who previously purchased or downloaded your content.
